
(OurNationNews.com) In the aftermath of the Supreme Court’s presidential immunity ruling, Senator Marco Rubio said he supports the decision. Rubio said the justices merely clarified the existing law and nothing has changed in regards to the powers a president has. The ruling determined that presidents have “broad immunity” for acts that are designated as official acts of the office.
Dissenting Justices Sonia Sotomayor and Ketanji Brown Jackson and Democratic party voters have slammed the ruling as providing the president the power of a king. Justice Jackson argued that a president could theoretically call for the assassination of a political opponent and receive a pass under the immunity clause.
Rubio pointed to clear differences between the way President Biden and Trump have governed the country. He said that Biden has weaponized the government to go after Trump. He added that when Trump was president, there weren’t any political persecutions of Democrats as a result of Trump’s leadership.
The ruling specifically calls for presumptive immunity for the president for engaging in constitutionally granted authority. This sets a high bar to prove that a president’s actions were criminal in nature, but still offers an option for criminal prosecution that would first require an impeachment and a congressional trial.
Dana Bash from CNN said Rubio is missing important context because Joe Biden’s DOJ has gone after Democrat Senator Bob Menendez. She is indicating that Biden’s administration cannot be guilty of political persecution because they have brought charges against a Democratic senator. Rubio said they would only go after certain Democrats who don’t do what the party would like them to do.
Justice Sotomayor claims that the ruling is a threat to democracy. Justice John Roberts wrote that the president does not have immunity for unofficial acts and thus is not above the law. He added that every occupant of the office shares the same level of immunity for official acts that are the president’s responsibility as dictated by the constitution. He said that power does not change based on “politics, policy, or party.
